Property Tax Service Agreement

The Abode Property Tax Service Agreement is incorporated into the Terms of Service (the “Agreement”) between you and Abode. All capitalized terms used and not defined herein shall have the meanings ascribed in the Agreement. BY ACCESSING THE SERVICES, YOU HAVE AGREED TO BE BOUND BY THE AGREEMENT AND THE PROPERTY TAX SERVICE AGREEMENT. PLEASE READ THE TERMS OF SERVICE AND PROPERTY TAX AGREEMENT CAREFULLY.

  1. PREAMBLE. This Property Tax Service Agreement applies to you to the extent that you access the Services for the purpose of lowering your property tax assessment. Services may vary by product and state.
  1. AUTHORIZATION.
    1. As part of the Services Abode may (a) provide you with information and forms for your use and consideration in self-filing your property tax assessment appeal, (b) act as your unlicensed limited agent for the purpose of appealing your property taxes where allowable by law, (c) monitor your property tax assessments, and/or (d) partner with, appoint, or connect you with third-party partners, including but not limited to licensed tax consultants, appraisers, certified accountants, or other licensed professionals for the purposes of representing you in your property tax assessment appeal.
    2. The authorization is limited to activities performed for the purpose of obtaining a lower property tax assessment from the relevant government agency or tax office, which may include but are not limited to: i) obtaining information about you, your property, and your property tax assessment from relevant property tax assessment or appraisal authorities; ii) communicating with property tax assessment or appraisal authorities on your behalf, iii) evaluation of your property tax assessment for errors and available exemptions, iv) preparing and filing on your behalf and with the applicable government agency or tax office evidence supporting a property reduction, v) appealing your property tax assessment, vi) representing you at related appeal hearings, vii) negotiating a reduction of your property tax with the relevant government agency or tax office, viii) monitoring of future assessments for appeal, and ix) assistance with future property tax appeals. The authorization does not include representing you in any secondary appeal, binding arbitration, or any appeal to a state or federal board or court.
    3. As part of the Services described at Subsection 2.1 above, you grant Abode the authority to appoint a licensed professional as the agent for you and the applicable property and to do so by executing and submitting to applicable authorities an “Appointment of Agent” form (or any similar agent authorization form required by the relevant property tax assessment or appraisal authorities, including a revocation of any previous property tax agent) on your behalf
  2. SERVICES. Pursuant to the Agreement and Sections 1 and 2 of the Property Tax Addendum above, Abode or a third-party tax consultant or other licensed professional acting as your agent may:
  • Perform an analysis of your property tax assessment for accuracy and available exemptions;
  • Prepare and file evidence supporting a reduction of your property tax assessment;
  • Represent you at applicable hearings or informal meetings in relation to filings described above;
  • Monitor on an on-going basis future yearly assessments and continue to provide the Services described above; and
  • Take any other actions as described at Section 2.

    If you access the self-filing product, Abode may provide you with information and forms for your use and consideration in self-filing your property tax assessment appeal.
  1. PAYMENT. Pursuant to the Agreement, Charges for the Services may be calculated and charged to you as either a flat fee, subscription fee, variable fee, or other fee, or as a Success Fee expressed as a percentage of the difference between your property tax bill for the specified year and the lowered property bill achieved for the same year, if any, as a result of the Services. Charges may include a combination of fees, including administrative fees. Subject to applicable notice requirements, Abode may change fees or add Charges for use of the Services at any time it deems necessary or appropriate for its business.  If you fail to timely pay Charges, you may be charged late fees under applicable law, including a late fee of up to $50 or more and / or interest of up to 1.5% a month or the maximum allowed by law on your delinquent balance.  Payment can be made online, over the phone, or by check sent to Abode at: 1909 Alexander Ave, #1119, Austin, TX, 78722.
  • Success Fee. If a lower property tax assessment is successfully obtained, you will be charged a Success Fee of the first year’s savings (amount defined in signed agreement). You will not be charged a fee unless your property tax bill is reduced.
  • Flat Fee. You have chosen to be charged a annual fee per property (amount defined in signed agreement). This non-refundable fee will be automatically charged each year to your payment method on file, unless you cancel in advance.
  1. REGULATORY. Pursuant to the Agreement, Abode partners with third-party partners, including but not limited to licensed tax consultants. Abode is not a licensed property assessor, appraiser, attorney, certified accountant or tax consultant. Abode does not provide any services deemed to be legal. To the extent any services requiring professional licensure are described in the Agreement or herein, they shall be provided by or with licensed third-party tax consultants or other third-party professionals.
  1. DISCLAIMERS. PURSUANT TO THE TERMS OF THE AGREEMENT, ABODE DOES NOT GUARANTEE OR WARRANT THAT YOUR USE OF THE SERVICES WILL RESULT IN A LOWERED TAX ASSESSMENT. Information and forms provided to you for use and consideration in self-filing of your property tax assessment appeal are for informational use only and do not constitute evidence, legal or professional advice, appraisal, professional comparative market analysis, or representation. If you access such information or forms for self-filing purposes, you are solely responsible for preparing your property tax assessment appeal and determining what evidence, documents, or testimony to provide to the relevant authorities.
  1. TERM AND TERMINATION. This Property Tax Service Agreement auto-renews on an annual basis and may be terminated pursuant to the terms of the Agreement. You remain responsible for all Charges due under the Agreement that arise from a Service provided prior to termination, including all flat fees, up-front fees, and subscription fees, all of which are non-refundable. This provision shall apply even if you have sold the property with regard to which the Services have been provided. Notwithstanding Section 14 of the Agreement, cancellations occurring within 30 days of the county’s official submission deadline for the year in which the services are being provided will be subject to a $50 cancellation fee payable to Abode.
  2. POWER OF ATTORNEY. For the purposes of Abode acting as your unlicensed limited agent, you authorize Abode to receive and inspect confidential tax information and to perform any and all acts that you can perform with respect to the tax matters described above (for example, the authority to sign any agreements, consents, or other documents).
  3. CLERICAL ERRORS. Pursuant to the Agreement, Abode may correct clerical errors to this Property Tax Service Agreement, the Agent Appointment, or similar agent authorization forms (for example, to correct errors in parcel numbers or street addresses) as Abode deems appropriate and without your approval. Such revised documents will be made available to you upon request.

YOU HAVE AGREED TO BE BOUND BY THE AGREEMENT INCLUDING THE PROPERTY TAX ADDENDUM.
